Public Beta Terms

The company warrenBrowse is being incorporated. Until it is registered, the responsible entity is referred to in this document as "the Warren team".

These terms govern your access to the Warren public beta and to the beta app. The beta is provided free of charge. No sale takes place, so no terms of sale apply to it.

1. Who provides the beta

The Warren public beta is made available by the Warren team.

No commercial company operates the service at this stage. A legal entity is being incorporated. It will take over the paid service when that opens and will then publish its own terms of use and terms of sale, with its full registration details. These terms cover the free beta only.

2. Definitions

  • Beta: the Warren public beta, comprising the test network and the beta app, as described on https://beta.warren.ro.
  • Beta app: the Warren client application distributed for the beta (Windows, macOS, Linux, Android).
  • Account: the anonymous account through which you access the Beta, identified by your account public key.
  • Account key: the cryptographic key created locally by the app on first launch, whose backup is shown to you as 12 words.
  • Beta voucher: the free access credit that the app attaches automatically to your Account when it is created.
  • Explorer: anyone who uses the Beta and reports to the Warren team what does not work.

3. Free of charge, no consideration

The service is provided free of charge, with no monetary consideration. No price is due, no bank card is requested, and no code is to be bought or typed: when the Account is created, the app automatically attaches the Beta voucher that credits your access time.

Three consequences follow, which the Warren team states explicitly:

  • Nothing is charged to you. No payment method is stored, no payment provider is involved, and no billing record is produced.
  • Rights attached to a distance purchase have nothing to apply to here. The statutory 14 day right of withdrawal, refunds and the commercial guarantee all presuppose a payment. They will apply in full to the paid service when it opens. None of these rights is waived or reduced by these terms: during the Beta there is simply no purchase for them to attach to.
  • Your rights over your personal data apply in full, with no reservation arising from the service being free (clause 11).

4. Eligibility and acceptance

You must be at least 18 years old, or the age of majority in your country of residence if that is higher, and have legal capacity to contract.

By installing the Beta app and using the Beta, you confirm that you meet these conditions and you accept these terms.

5. What the beta service is

The Beta is a test environment, built to find defects before the full service opens. Its characteristics are deliberately reduced:

  • Capped bandwidth. Throughput is limited during the Beta, to 20 Mbps at the start of the programme. This cap may be adjusted.
  • Reduced performance compared with the final service, and variable latency depending on the node.
  • Expected interruptions. Restarts, outages, regressions and downtime are part of the normal operation of a beta.
  • Moving features. They may change, be added or be removed without notice.
  • Possible resets. Accounts, credited time and network state may be reset if development requires it. The Warren team announces this on https://beta.warren.ro and on the forum when it can foresee it.
  • 3 simultaneous connections per Account. The same account key may be installed on an unlimited number of devices.

The Warren team gives no availability commitment and guarantees no service level.

Warren provides a mere conduit service within the meaning of Article 4 of Regulation (EU) 2022/2065: the Warren team does not initiate the transmissions made through the tunnel, it does not select their recipients, and it neither selects nor modifies the information transmitted. The Warren team hosts no content on behalf of its users.

6. Your account and your key

Your Account is identified by your account public key. Because the Beta runs without logging and without email, your account key is the sole proof of your right of access.

You are solely responsible for protecting your 12 words. Keep them secret and back them up away from your device. The Warren team cannot recover a lost key: by design, it holds no copy of it. Anyone holding your key can use your access.

7. No logging

Warren logs no user activity during the Beta: no traffic logs, no DNS query logs, no connection logs, no source IP logs, no per-user bandwidth logs. The data the Warren team does process is listed in its Privacy Policy.

By a bounded exception to the above, and solely to preserve the availability of the network with its hosting providers, the Warren team keeps a per-Account strike counter described in clause 9. It holds no destination, no port and no activity history.

8. Your role as an explorer

The Beta exists to be put under strain. The Warren team asks you to use Warren for real and to report to it what does not work, on the forum.

  • Participation is voluntary. You have no obligation to report anything, no quota, and no deadline to meet.
  • It is unpaid and creates between you and the Warren team no employment, service, agency or partnership relationship.
  • Your feedback serves to fix things. For the descriptions, screenshots, videos and logs you send the Warren team, you keep your rights and you grant the Warren team a non-exclusive, royalty-free, worldwide licence of unlimited duration to use, reproduce and adapt them for the sole purpose of diagnosing and improving Warren.
  • Logs attached to a report leave your device only after an explicit confirmation by you in the app, and after an automatic pass that replaces IP addresses, MAC addresses, technical identifiers and your home directory paths. They are delivered to the support team alone and never appear publicly (clause 5 of the Privacy Policy).
  • The forum has its own posting rules, available there. Forum access happens from the app, by signing with your account key.

9. Acceptable use

You undertake not to use the Beta, and not to allow it to be used:

  • for any illegal activity, or to facilitate one;
  • to send spam or unsolicited bulk messages;
  • to attack, overload, abusively port-scan, cause a denial of service, penetrate or otherwise compromise any network, system or infrastructure, whether the Warren team's or a third party's;
  • to distribute child sexual abuse material (CSAM), or content infringing intellectual property, privacy or other rights of others;
  • to resell, sublicense, rent or make the Beta available to third parties as a service;
  • to circumvent the bandwidth cap, the Beta voucher allocation mechanism, an account limit or a security measure of the Beta, or to create Accounts in bulk in order to obtain more free access.

The Warren team does not monitor the content of your traffic and cannot moderate your usage in advance. The uses above are contractually forbidden nonetheless. In the event of established abuse, or under a valid legal order, the Warren team may suspend or terminate the Account concerned (clause 12). It acts on specific, established grounds.

Reports about a port opened through port forwarding. When a third party reports abuse originating from a port you opened through the tunnel, the Warren team may close that port and record a strike against the Account that held it at the time of the report. An Account reaching three strikes within a rolling ninety-day window is revoked and loses network access. A strike older than that window stops counting. Every strike is decided by a human, never automatically, and you may contest it through the procedure described on the Warren team's Reports page.

10. Licence and intellectual property

The Warren team grants you a limited, revocable, non-exclusive and non-transferable licence to install and use the Beta app and the Beta, for your personal use and for the duration of the programme.

The names "Warren" and "warrenBrowse", the Warren team's logos, the service infrastructure and the server software belong to the Warren team or to its licensors. The Warren client applications are distributed under their respective open source licences, which govern your rights over the client software and prevail over this clause in the event of conflict for that software.

11. Personal data

The processing of your personal data during the Beta is governed by the Privacy Policy of the Warren team. The GDPR applies in full; the service being free changes none of your rights.

12. Suspension, termination and end of the programme

The Warren team may suspend or terminate your Account where you breach clause 9, where it finds fraud or established abuse affecting the Warren team, other users or third parties, or where a valid legal order or applicable law requires it. Where possible and lawful, the Warren team tells you, and for a remediable breach it allows you a reasonable opportunity to remedy it.

You may stop using the Beta at any time, with no formality.

The Warren team may change the Beta, alter its characteristics or bring it to an end. It announces the end of the programme on https://beta.warren.ro and on the forum with reasonable notice.

Because the service is free, a suspension, a termination or the end of the programme gives rise to no compensation and no refund, the credited time having been the subject of no payment.

13. No warranty

The Beta is provided "as is" and "as available", without warranty of any kind, express or implied, and in particular without warranty of continuous operation, performance, freedom from error or fitness for a particular purpose.

The Beta is a test environment: do not use it as your only protection in a situation where your physical or legal safety depends on the tunnel working correctly.

This clause does not exclude or limit the mandatory rights you have as a consumer under applicable law.

14. Liability

Because the Beta is provided free of charge, the Warren team's liability is limited to damage caused by gross negligence or wilful misconduct.

Nothing in these terms excludes or limits the Warren team's liability for: death or personal injury caused by its negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited under applicable law, including the mandatory rights you have as a consumer.

15. Changes to these terms

The Warren team may change these terms for a justified reason (legal, technical or programme developments), stated in the notice. Changes are dated and announced on https://beta.warren.ro and on the forum with reasonable notice. A change does not apply retroactively, and you may stop using the Beta if it does not suit you.

16. Opening of the paid service

When the paid service opens, it will be the subject of a separate contract, with its own terms of use and terms of sale, its refund and withdrawal terms, and the registration details of the company operating it. The free beta remains governed by these terms for as long as it stays open.

17. Governing law and disputes

The Warren team imposes no choice of law on you. If you are a consumer, the contract is therefore governed by the law of your country of habitual residence, with all of its mandatory protections (Rome I Regulation, art. 6(1)).

If you are a consumer established in the European Union, you may bring proceedings against the Warren team before the courts of your domicile, and you may be sued only before those same courts (Brussels I bis Regulation (EU) 1215/2012, art. 17 to 19).

18. General provisions

  • Severability: if any provision is held invalid or unenforceable, the others remain in full force, and the invalid provision is construed narrowly to the minimum extent necessary or, failing that, treated as not written.
  • Waiver: the Warren team's failure or delay in enforcing a provision is not a waiver of it.
  • Force majeure: neither party is liable for a failure or delay in performance caused by events beyond its reasonable control.
  • Notices: the Warren team notifies you by in-app message, by publication on https://beta.warren.ro or on the forum; you notify the Warren team validly at contact@warrenbrowse.com.
  • Survival: clauses 7, 8, 10, 11, 14 and 17 continue to apply after your participation ends.

Nothing in this clause 18 excludes or limits any liability or right that cannot be excluded or limited under applicable law, including consumers' mandatory rights.
